Terms of Service

These Terms of Service govern the use of the Apex Machina platform and the purchase of associated credits. Any use of the service implies full acceptance of these terms.
1. Purpose
Apex Machina is a B2B prospecting tool (an “ORM”) for company targeting, contact enrichment (LinkedIn, email, phone), AI scoring and first-touch management. The service is sold as a “top-up” credit model, with no subscription.
2. Registration and access
The service is currently available in limited access (beta). Registration is by invitation after a request form. Users must provide accurate information and use the service for professional purposes only.
3. Pricing and payment
Prices are quoted in euros on apexmachina.fr/en/pricing. Payment is made exclusively by credit card via Stripe. €1 = 100 credits. No subscription is taken: credits are purchased on demand (top-up).
4. Credit usage and refunds
Each consumable action (LinkedIn scraping, email enrichment, AI analysis, etc.) is billed in credits per the published rate card. If an action returns no usable data (e.g. email not found), credits are automatically refunded to the account. Purchased credits do not expire while the account is active.
5. Right of withdrawal
Since the service is intended exclusively for professionals (B2B) and credit purchases constitute an immediately performed service, the right of withdrawal under article L221-18 of the French Consumer Code does not apply (article L221-3 exception).
6. User obligations
The user agrees to comply with GDPR when using obtained data, not to exceed the technical limits of the service, not to attempt to access data not intended for them, and not to use the service for illicit purposes (mass spam, identity theft, etc.).
7. Availability and suspension
Apex Machina makes best efforts to keep the service available. In case of maintenance, incident or security emergency, the service may be suspended without notice. In case of clear breach of these terms, the account may be suspended, with unused credits then refunded.
8. Limitation of liability
Apex Machina provides the service “as is” (“best effort”). Its liability is capped at the unused credits balance at the time of dispute. Apex Machina shall not be liable for commercial decisions made by the user based on the data provided, nor for third-party content (LinkedIn, enrichment providers).
9. Changes, applicable law and disputes
Apex Machina reserves the right to modify these terms. Changes are notified by email and take effect within 30 days. These terms are governed by French law. In case of dispute, after attempting amicable resolution, French courts shall have exclusive jurisdiction. For any question: contact@apexmachina.fr.
